436 Capital LLC ("436 Capital," "we," "us," or "our") is a real estate firm. This Privacy Policy explains what information we collect, the sources we collect it from, how we use and share it, how long we keep it, and the rights and choices you have. It applies to our website, our forms, our advertising (including on Facebook and Instagram), and our outreach to property owners.
When we say "personal information," we mean any information that identifies or relates to an identified or identifiable individual.
1. Information We Collect & Where It Comes From
Information You Provide
- Contact information: your name, email address, phone number, and mailing address — including information you submit through our website forms or through Facebook/Instagram lead forms.
- Property & ownership information: details about a property you own or wish to sell — such as its location, size, occupancy, and financials — that you choose to share with us.
- Inquiries & communications: messages, form submissions, and any information you include when you contact us or respond to our outreach.
Information We Obtain About Property Owners
To reach property owners who may be interested in selling, we also collect contact and ownership information (such as names, mailing addresses, phone numbers, and email addresses) from public records (for example, county assessor and deed records) and from third-party data providers.
Information We Collect Automatically
Our website does not use advertising or analytics trackers (see Section 4). When you visit, our hosting provider may record standard server-log data such as your IP address and browser type, which is used only to operate and secure the site.
Sensitive Information
We do not intentionally collect, and we do not sell, sensitive personal information (such as government ID or financial account numbers).
2. How We Use Your Information
We use your information to:
- Respond to your inquiries and communicate with you about selling or operating a property
- Evaluate and complete potential property transactions with owners interested in selling
- Operate, maintain, and improve our website
- Create and deliver advertising, including through Meta (Facebook and Instagram)
- Send you relevant updates and marketing communications (with your consent where required — you can opt out anytime)
- Detect and prevent fraud and protect the security of our website
- Comply with legal obligations and enforce our agreements
Data minimization. We limit our collection and use of personal information to what is reasonably necessary and proportionate for the purposes described above. We do not use your personal information to make decisions that produce legal or similarly significant effects about you through solely automated processing.
3. How We Share Your Information
Advertising (Meta).We use Meta's advertising tools (Facebook and Instagram), including Custom Audiences and lead ads. We may share contact information (such as email addresses and phone numbers), in hashed (irreversibly encoded) form, with Meta so it can match it to its users and deliver our ads to relevant audiences. This activity may be considered a "sale" or "sharing" of personal information, or "processing for targeted advertising," under certain state laws. You can opt out — see Section 6.
We may also share your information with:
- Service providers: website hosting, web-form processing, and email delivery tools that perform services for us and are bound to use the information only on our behalf
- Professional advisors: attorneys, accountants, lenders, brokers, and other partners involved in evaluating or closing a transaction
- Legal requirements and business transfers: when required by law, court order, or to protect rights and safety, or in connection with a merger, financing, or sale of assets
- With your consent: when you explicitly authorize us to share information
We may share aggregated or de-identified data that cannot identify you.
4. Cookies & Tracking
Our website does not use third-party advertising pixels or analytics trackers, and it does not build advertising profiles of your activity across other sites. We use only the cookies and similar technologies that are strictly necessary for the site to function and stay secure. If we add analytics or advertising technologies in the future, we will update this Policy first.
5. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect your information. Internal access to personal information is restricted to team members and service providers who need it to operate our business. However, no system is 100% secure, and we cannot guarantee the absolute security of your information.
6. Your Rights and Choices
Depending on where you live, you may have some or all of the following rights:
- Know / access: request a copy of the personal information we have collected about you
- Correct: update inaccurate or incomplete information
- Delete: request deletion of your data
- Portability: receive your information in a portable format
- Opt out of "sale" or "sharing" of your personal information and of targeted / cross-context behavioral advertising(including our use of your information for advertising audiences)
- Limit the use of sensitive personal information (we do not use it beyond permitted purposes)
- List of third parties: where your state grants it (e.g., Oregon), obtain a list of the specific third parties to whom we disclosed personal information
- Non-discrimination: we will not discriminate or retaliate against you for exercising these rights
How to Exercise Your Rights
To submit a request, email us at team@436capital.com. You may also use an authorized agent. We will verify your identity before fulfilling a request and will respond within the time required by your state's law (generally within 30–45 days). We do not require you to create an account to submit a request.
Opt Out of Sale/Sharing and Targeted Advertising
Because our website does not use advertising or analytics trackers, the main way your information may be "shared" is when we include owner contact information in an advertising audience (Section 3). To opt out of the "sale" or "sharing" of your personal information and of targeted advertising, email us at team@436capital.com with the subject "Do Not Sell or Share," and we will remove you. Where applicable, we also honor recognized opt-out preference signals such as the Global Privacy Control (GPC).
Right to Appeal
If we decline to act on your request, you may appeal by emailing team@436capital.com with the subject "Privacy Appeal." We will respond to your appeal within the time required by your state's law and explain our reasoning. If your appeal is denied, you may contact your state Attorney General to submit a complaint.
7. Data Retention
We keep each category of personal information only as long as reasonably necessary for the purposes described in this Policy, based on criteria such as: whether we have an active or prospective relationship regarding a property; our legitimate operational and advertising needs; and our legal, tax, and recordkeeping obligations. When information is no longer needed, we delete or de-identify it.
8. Children's Privacy
Our website is intended for property owners and is not directed to children. We do not knowingly collect personal information from children under 13.
9. State-Specific Privacy Rights
California Residents (CCPA/CPRA)
California residents have the rights described in Section 6, including the right to know, delete, correct, opt out of the sale or sharing of personal information, and limit the use of sensitive personal information. Our sharing of owner contact information with advertising partners (such as Meta) may be considered a "sale" or "sharing" — you may opt out as described above. Under California's "Shine the Light" law, California residents may request information about disclosures of personal information to third parties for those third parties' direct marketing by emailing team@436capital.com. We do not knowingly sell or share the personal information of consumers under 16.
Texas and Other States
Residents of Texas, Colorado, Connecticut, Oregon, Maryland, Minnesota, New Jersey, Virginia, and other states with comprehensive privacy laws have the rights described in Section 6, including the right to opt out of targeted advertising and the sale of personal data, and the right to appeal a denied request as described above.

We may update this Privacy Policy from time to time. We will post changes on this page and update the "Last updated" date above.
